Upcoming Firm News: CLE Presentation to Minnesota Lawyers at the Complete Probate Lawyer

I have been asked to join the faculty for an upcoming seminar, “The Complete Probate Lawyer.” On May 28th, Minnesota Continuing Legal Education (MNCLE) is hosting “The Complete Probate Lawyer” to teach newer attorneys in how to manage a probate from beginning to end. I have been asked to present on the topic: “Miscellaneous Procedures.”

Meaning: MNCLE needed a presentation on the weird and strange probate procedures only used in unusual or odd cases, taught by a real probate nerd. Please use this link for more details on the all day seminar. My presentation will focus on:

-Affidavits of Collection: An Affidavit that is used when you have a “small estate” that is not big enough to justify a full court probate.

-Summary Administrations: A proceeding typically used when you do need a probate proceeding of some kind, but the type of assets are such that you can avoid a full, months-long probate and instead have only a single Court hearing.

-Determination of Descent Proceedings: A court process to handle the assets of a decedent who died more than three years ago (but no one ever started the probate in that time).

-Re-Opening Closed Probates: A discussion of the ways to determine how to re-open an older probate to administer newly-discovered assets.

-Special Administrations: A flexible process that can be used in a variety of truly odd situations.
